Waiver
AIRSHOW VOLUNTEER RELEASE AND HOLD HARMLESS AGREEMENT
By volunteering with the National Warplane Museum Geneseo Airshow, volunteer agrees that:
(a) Volunteer shall not transmit or aid in transmitting any information about the National Warplane Museum – Geneseo Airshow (the “Air Show”), including, but not limited to, any account, description, picture, video, audio, reproduction, or other information (hereinafter “Recordings”) concerning the Air Show. The National Warplane Museum – Geneseo Airshow (“NWM – Geneseo Airshow”) realizes that the taking and making of Recordings allows attendees to capture the unique experience of attending the Air Show and provides them with a personal record of such experience. To that end, attendees may make Recordings for their personal use and enjoyment only.
NWM – Geneseo Airshow owns all trademarks, copyrights, and other proprietary rights connected to the Air Show and retains all worldwide rights. Any broadcast, rebroadcast, or publication of any accounts, pictures, or descriptions of the Air Show (excepting news broadcasts by legitimately accredited and credentialed news media) without the prior written consent of NWM – Geneseo Airshow is prohibited;
(b) NWM – Geneseo Airshow and each of its respective agents, employees, and contractors shall have the unrestricted right and license to use Volunteer’s image, likeness, name, voice, comments or other proprietary or public rights and that of any minor accompanying Volunteer in any broadcast, telecast, photograph, video and/or audio sound recording taken in connection with the Air Show or other transmission or reproduction of NWM – Geneseo Airshow in whole or in part, for all purposes, without compensation of any kind whatsoever; and
(c) Volunteer shall adhere to any additional Air Show rules or regulations that apply.
The Volunteer, on behalf of himself or herself, and on behalf of any minor accompanying Volunteer to the Air Show:
(a) voluntarily assumes all risks incidental to attending the Air Show, including without limitation the risk of lost, stolen or damaged property, or personal injury;
(b) waives, releases, and discharges the City of Geneseo, NWM – Geneseo Airshow, and their respective members, shareholders, trustees, directors, officers, employees, volunteers, contractors, and agents (collectively the “Indemnitees”) from any and all negligence and liability for Volunteer’s death, disability, personal injury, property damage, property theft, or claims of any nature which may accrue to Volunteer as a direct or indirect result of Volunteer attending the Air Show; and
(c) agrees to defend, indemnify, and hold harmless the Indemnitees from and against any and all claims, suits, damages, and liabilities of any nature including all costs, expenses, and attorneys’ fees, which in any manner result from Volunteer’s attendance or actions during the Air Show.
(d) agrees to comply with the NWM – Geneseo Airshow COVID-19 Health & Safety Protocols and assumes all risks related to exposure to COVID-19.
(e) It is understood and agreed that all rights under the statute which provides as follows, "Certain Claims Not Affected by General Release - A general release does not extend to claims
which the creditor does not know or suspect to exist in his favor at the time of executing the release, which if known by him must have materially affected his settlement with the debtor," are hereby expressly waived.
(f)Fully understanding that air shows are activities that include situations that pose a danger to me and my personal property, I hereby acknowledge and assume all risk of injuries or damage to my person or property. No promise or inducement, which is not herein expressed, has been made to me, and in executing this Release I do not rely upon any statement or representation made by any person or their agent.
(g) I further state that I carefully read the foregoing Release and know the contents thereof, and I sign the same as my own free act.
NWM – Geneseo Airshow may revoke volunteer status and eject or refuse entry to the Volunteer for violation of venue rules, illegal activity, misconduct, or failure to comply with any and all security measures. Volunteer agrees to comply with NWM – Geneseo Airshow Entry Restrictions. Volunteer consents to reasonable examinations and searches to ensure compliance with laws and NWM – Geneseo Airshow rules.
Volunteer acknowledges that possessing, consuming, using, and/or being under the influence of illegal substances are not permitted on Air Show premises, including but not limited to marijuana.
All volunteers are prohibited from purchasing, transferring, using, possessing or being under the influence illegal drugs. Violations of this policy is proper cause for immediate discharge from volunteering.
Volunteers who are under the influence of alcohol, have alcohol in their possession or consume alcohol during the course of executing volunteer duties will be subject to immediate discharge from volunteering.
Volunteers undergoing medical treatment involving prescribed medications which could adversely affect performance, such as drugs which should not be used when operating machinery, motor vehicles, or around aircraft, etc. must report this treatment to their division director. Even though the use of such drugs, such as marijuana, as prescribed by a physician is legal, it may be necessary to modify a volunteer’s duties which might be adversely affected by the use of such drugs.
Volunteer is prohibited from possessing, consuming, using, and/or being under the influence of cannabis while on National Warplane Museum property and while executing volunteer duties. Violation of this will result in the volunteer's immediate discharge.
Volunteer voluntarily assumes all risks associated with volunteering at and for the NWM - Geneseo Airshow.
AIRSHOW VOLUNTEER CODE OF CONDUCT
OVERVIEW
The National Warplane Museum - Geneseo Airshow is committed to developing event volunteer policies and practices and, in doing so, has implemented an Event Volunteer Standards of Conduct Policy to increase the safe and supportive environment for all event volunteers at the National Warplane Museum - Geneseo Airshow.
DEFINITIONS
For the purposes of this policy, the following are defined.
National Warplane Museum - Geneseo Airshow: The annual Airshow event hosted and produced by the National Warplane Museum
Event Volunteer: An individual who is specifically supporting the National Warplane Museum - Geneseo Airshow in a volunteer capacity. This may include National Warplane Museum members or other individuals who volunteer at the National Warplane Museum during normal museum operations
Corrective Action: An action taken by the National Warplane Museum - Geneseo Airshow Executive Director or their designee(s) to address a violation of this policy
Severe Violation: Any violation of this policy that leads to (1) significant negative physical or emotional harm on any other individual or (2) substantially hinders the National Warplane Museum Geneseo Airshow’s operation or (3) places the Event Volunteer, or any other individual in an extremely unsafe condition
PURPOSE
The purpose of this policy is to support a safe and protective environment for event volunteers through the establishment of Event Volunteer Standards of Conduct. This policy is also intended to increase volunteer awareness of how to conduct themselves while supporting the National Warplane Museum - Geneseo Airshow.
OBJECTIVE
The objective of this policy is to establish a clear set of expectations for event volunteers that are supporting the National Warplane Museum - Geneseo Airshow in any volunteer capacity. The codified Volunteer Standards of Conduct is aligned with National Warplane Museum organizational standards and expectations of equivalent organizations.
SCOPE
This policy applies to all individuals serving in any volunteer capacity, including those who are directly affiliated as a volunteer with the National Warplane Museum - Geneseo Airshow or those who are indirectly affiliated as a volunteer with a third party or non related organization. This policy applies to any event or pre-event associated with the National Warplane Museum - Geneseo Airshow including but not limited to training, training exercises, and team meetings.
RESPONSIBILITY
*It is the responsibility of the National Warplane Museum - Geneseo Airshow Managing Director or their designee(s) to enforce this policy.
*It is the responsibility of Division Directors to ensure that all event volunteers are aware of and educated on this policy. It is also the responsibility of the Division Director to maintain a written record of any reported violation of this policy and to then collaborate with the Airshow Executive Director or their designee(s) when any enforcement action is taken in relation to this policy.
*It is the responsibility of the Event Volunteer to adhere to this policy and to report any concerns that pertain to violations of this policy to their Division Director. It is also the responsibility of the Event Volunteer to seek clarity if there is any confusion regarding the Event Volunteer Standards of Conduct.
*It is the responsibility of all parties noted above to practice and exude the standards of conduct listed in this policy.
POLICY
*Event volunteers shall act honestly and ethically while in the performance of their event volunteer duties regardless of the capacity in which the event volunteer serves or the department or division that the event volunteer serves in.
*Event volunteers shall treat all other event volunteers, members of the public, customers, and other individuals not specifically named both who attend the National Warplane Museum - Geneseo Airshow and those who interact with the organization on social media with respect, courtesy, and dignity.
*Event volunteers shall not discriminate and shall be respectful of all ethical, natural, and cultural differences of all other event volunteers, members of the public, customers, or other individuals not specifically named.
*Event volunteers shall not harass, bully, or mistreat in any way other event volunteers, members of the public, customers, or other individuals not specifically named.
*Event volunteers shall obey all applicable local, state, and federal laws, while acting on behalf of the National Warplane Museum - Geneseo Airshow.
*Event volunteers shall deter wrongdoing and ensure accountability for adherence to the Event Volunteer Code of Conduct.
*Event volunteers shall assist and cooperate with all investigations initiated by the National Warplane Museum - Geneseo Airshow, or other investigating body.
*Event volunteers shall report violations or suspected violations of the Event Volunteer Standards of Conduct to their assigned Division Director.
*Event volunteers shall seek assistance if they have questions about this policy from their Division Director.
*Event volunteers are responsible for their own physical health and safety and mental wellbeing while discharging their volunteer duties. Any event volunteer who feels they are unable to perform their duties due to concerns related to their physical health and safety or mental wellbeing should report immediately to their Division Director.
*Event volunteers should maintain a proactive and protective stance towards the safety and wellbeing of all members of the public and customers who are attending the National Warplane Museum - Geneseo Airshow. Should an unsafe condition arise, event volunteers should attempt to address the condition immediately if safe to do so. If not, the event volunteer should report immediately to their assigned Division Director.
*Event volunteers shall never smoke or use electronic cigarettes while outside of designated smoking areas.
*Event volunteers shall arrive at the event in appropriate attire to discharge their duties.
*Event volunteers shall never be under the influence or impaired by any illegal, illicit, or other substances that may lead to impairment including but not limited to mind altering substances such as alcohol, illegal drugs, cannabis, or other substances not specifically listed while actively participating in the capacity of Event Volunteer.
CORRECTIVE ACTION
The National Warplane Museum - Geneseo Airshow will make reasonable attempts to engage in progressive corrective action practices when addressing violations of the Event Volunteer Standards of Conduct. Engagement in progressive corrective action practices is dependent on the gravity of the violation. Severe violations of the Event Volunteer Standards of Conduct may result in the immediate dismissal of the event volunteer.
Progressive corrective action practices could include but are not limited to:
*Assignment of Event Volunteer to a different Team
*Assignment of Event Volunteer to a different Division
*Temporary suspension of Event Volunteer’s ability to serve in such capacity
The National Warplane Museum - Geneseo Airshow reserves the right to immediately dismiss any event volunteer who is found through thorough investigation by the Airshow Executive Director or their designee(s) to have violated the Event Volunteer Standards of Conduct. This dismissal applies to any individual serving as an Event Volunteer including those who serve in a volunteer capacity during normal museum operations.
If an event volunteer was found to have committed a severe violation of this policy, the event volunteer is required to surrender all National Warplane Museum - Geneseo Airshow property in undamaged condition and will then be escorted off of the National Warplane Museum Property. The dismissed individual is not permitted on the National Warplane Museum Property for the remainder of the event even if the individual is a registered member of the museum. Any individual who has been dismissed as an Event Volunteer during previous events is not eligible to return as an Event Volunteer unless otherwise authorized by the President of the National Warplane Museum or their designee(s). The National Warplane Museum Geneseo Airshow reserves the right to exercise legal recourse if any individual fails to comply with this provision.
CONFIDENTIALITY
Any information discovered through the course of any investigation initiated due to a violation or suspected violation of this policy is considered confidential information and is made accessible only to the Airshow Executive Director or their designee(s) or to the Event Volunteer’s Division Director.
APPEAL
Any Event Volunteer who is not satisfied with a determination of the National Warplane Museum - Geneseo Airshow Executive Director or their designee(s), whether the Event Volunteer is subject to corrective action or the Event Volunteer is a suspected victim of a violation of the Event Volunteer Standards of Conduct is permitted to file an appeal by contacting the President of the National Warplane Museum or their designee(s).
